Welcome to WeekendyApp. These Terms and Conditions ("Terms") govern your access to and use of the WeekendyApp website and services ("Service"). By creating an account or using our Service, you agree to be bound by these Terms. Please read them carefully.

1. Description of Service

WeekendyApp is a platform designed to connect individuals for participating in fun, social, and recreational activities. This includes outdoor events, meetups for shared hobbies, and other group activities. While our primary focus is on platonic connections, we also offer features that can be used for dating. Our service is not intended for hook-ups or escort services.

2. User Eligibility

You must be at least 21 years of age to create an account and use the Service. As activities suggested on our platform may involve venues or events where alcohol is served, we adhere to the legal age requirement of 21 in Kenya. By using WeekendyApp, you represent and warrant that you meet this age requirement.

3. User Conduct and Prohibited Activities

You agree to use the Service responsibly and in compliance with all applicable laws of the Republic of Kenya. The following conduct is strictly prohibited:

• Illegal Activities: You may not use the Service to promote, engage in, or facilitate any illegal activity. This includes, but is not limited to, fraud, drug-related offenses, and any other activities violating the Penal Code of Kenya.
• Prostitution and Solicitation: The use of WeekendyApp for soliciting, arranging, or engaging in prostitution or any form of transactional sexual-commercial activity is strictly forbidden. Any such activity violates our core principles and is grounds for an immediate and permanent ban. We maintain a zero-tolerance policy for any content or conduct that violates the Sexual Offences Act.
• Pornographic and Obscene Content: You may not post, share, or distribute any pornographic, obscene, or sexually explicit content. This is a direct violation of the Computer Misuse and Cybercrimes Act, 2018, and will result in immediate termination of your account.
• Harassment and Threats: Harassing, intimidating, stalking, or threatening other users is prohibited. This includes hate speech, discriminatory language, or any form of abuse.
• Financial Transactions: WeekendyApp is not a platform for financial transactions between users. You are strictly prohibited from using the Service to solicit money, arrange financial deals, or engage in any form of scam or fraudulent financial activity. We are not responsible for any financial losses incurred through interactions with other users.
• Impersonation: You may not impersonate any person or entity or falsely state your affiliation with any person or entity.
• Spam: You may not use the Service to send unsolicited messages, advertisements, or spam.

Violation of these rules may lead to the suspension or permanent ban of your account without notice. We reserve the right to report any illegal activities to the relevant Kenyan law enforcement authorities.

4. User Safety and Disclaimers

Your safety is your personal responsibility. You agree to use caution in all interactions with other users, both online and offline.

• No Background Checks: You understand and agree that WeekendyApp DOES NOT conduct criminal background checks, identity verification checks, or any other form of screening on its users. We do not verify the information provided by users.
• Assumption of Risk: You assume all risks when using the Service, including but not limited to all risks associated with any online or offline interactions with others, including meetings.
• Limitation of Liability: WeekendyApp is not liable for what happens between users outside of our platform. We are not responsible for any direct, indirect, incidental, or consequential damages, including but not limited to, physical harm, emotional distress, or financial loss resulting from your interactions with other users. You agree to take reasonable precautions in all communications and interactions.

5. Refund Policy

Once a user has paid and accessed the in-app features of our service, they are deemed to have interacted with and consumed the service provided. Therefore, we do not offer refunds after a user has visited the in-app section. This policy applies even if the user has not initiated contact with other users (e.g., by clicking a WhatsApp button). All transactions are final.

6. Data Privacy and Protection

We are committed to protecting your privacy. Our use of your personal data is governed by our Privacy Policy and in accordance with the Kenyan Data Protection Act, 2019.

• Your personal data, including your phone number and location, is collected for the primary purpose of facilitating connections within the WeekendyApp platform.
• We do not sell, trade, or otherwise share your personal data with third parties for marketing purposes.
• While we implement security measures to protect your data, we cannot guarantee absolute security.

7. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any conduct that we believe violates these Terms, is harmful to other users, or is detrimental to the WeekendyApp community.

8. Governing Law

These Terms and any dispute arising out of your use of the Service shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

9. Changes to Terms

We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
